    These terms govern superherosretreat.com. A reservation is also governed by the guest rental agreement Hospitable shows you before you pay. If the two conflict on the stay itself, the rental agreement controls.

    1. Agreement to these terms

    Superheroes Retreat (“we,” “us”) operates this website. By browsing, submitting the contact form, or starting a booking, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site.

    2. Who we are

    Superheroes Retreat is a short-term rental in Terra Lago, Indio, California, in the Coachella Valley. Website questions: support@superherosretreat.com or the contact form.

    3. The website versus the stay

    This site is a marketing and booking front end. It describes the home, shows photos, and embeds a calendar. The stay — occupancy, house rules, payment, cancellation, and damages — is governed by the Hospitable rental agreement you accept at checkout, plus applicable City of Indio short-term rental rules. These website terms do not replace that contract.

    4. Bookings and payment

    Reservations, availability, the stay total, payment, and the rental agreement are processed by Hospitable. We do not store card numbers on this website. You must be old enough to form a binding contract and authorized to use the payment method. The total shown in the calendar before you reserve includes mandatory stay charges and government taxes. Optional add-ons (pets, pool heating, EV charging, early check-in) are listed on Fees and stay details and are charged only if you use them.

    We may also list the home on Airbnb, VRBO, Booking.com, and Expedia. A booking on those platforms is subject to that platform’s terms as well as our rental agreement.

    5. Accuracy, photos, and amenities

    We try to keep descriptions, photos, drive times, and amenity lists accurate. Drive times are estimates and change with traffic. Amenities can be temporarily unavailable (repairs, weather, supplier issues). Photos show the home; they are not a warranty that every visit will look identical. If something material is wrong, email us before or during the stay.

    6. House rules, occupancy, and local law

    Maximum occupancy, permitted bedrooms, and maximum vehicles are stated on this site and enforced by the City of Indio. Unregistered guests, parties, smoking, and street parking can end the stay and lead to city fines. You are responsible for everyone in your group. Read House rules before you book.

    7. Cancellation, deposit, and refunds

    Cancellation and the security deposit follow the terms Hospitable shows before you confirm. A plain-language summary is on the Cancellation page. The deposit works like a hotel incidental hold. We do not usually charge for ordinary minor wear.

    8. Guest Wi-Fi (StayFi)

    After check-in, house Wi-Fi is provided through StayFi. Connecting typically requires a splash page where guests enter an email address and mobile number. StayFi is not part of this website’s booking form. We use those details to operate Wi-Fi and, where you consent on that splash page, to send stay-related and marketing messages. See the Privacy Policy and the consent language on the StayFi screen.

    9. Contact form

    Messages sent through this site must be truthful. Do not use the form to harass, spam, or send unlawful content. We may refuse or ignore abusive submissions.

    10. Acceptable use

    You may not:

    • break or probe the site’s security, or overload it;
    • scrape or harvest the site in a way that harms the service or copies our listing;
    • impersonate us or another person;
    • use the site for any unlawful purpose, including violating Indio STR rules;
    • frame the site or remove notices without permission.

    We may block access if we reasonably believe these rules were broken.

    11. Intellectual property

    Photos, text, logos, and layout on this site belong to Superheroes Retreat or our licensors. You may share links and use brief quotations for personal, non-commercial purposes. You may not copy the site, photos, or branding for a competing listing or commercial reuse without written permission.

    12. Third-party services and links

    The site embeds or links to Hospitable, Google Maps, Google Analytics (if you consent), Resend (contact email), Railway (hosting), and OTA listing pages. Those services have their own terms. We are not responsible for their content or practices. StayFi operates at the property, not as a page on this website.

    13. Disclaimer of warranties

    The website is provided “as is” and “as available.” To the fullest extent California law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement for the website itself. This does not limit warranties or duties that cannot be disclaimed for a consumer lodging stay under California law, and it does not replace the rental agreement.

    14. Limitation of liability

    To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website (including lost profits or data). Our aggregate liability arising from the website is limited to one hundred U.S. dollars, or the amount you paid us through this site in the three months before the claim, whichever is greater. This cap does not apply to liability that California law does not allow us to limit, including certain personal-injury claims, and it does not rewrite the rental agreement for the stay.

    15. Indemnity

    You will defend and indemnify us against claims and reasonable costs arising from your misuse of the website, your group’s violation of house rules or Indio ordinances, or content you submit through the contact form, except to the extent caused by our own misconduct.

    16. Changes

    We may update these terms. The “Last updated” date at the top will change. Continued use after an update means you accept the new terms. Material changes that affect an existing reservation will not rewrite that reservation’s rental agreement.

    17. Governing law and venue

    These website terms are governed by the State of California, without regard to conflict-of-law rules. Exclusive venue for disputes about the website is the state or federal courts in Riverside County, California, except where a consumer-protection statute requires otherwise.

    18. General

    If a provision is unenforceable, the rest remains in effect. These terms are the entire agreement about the website. Failure to enforce a provision is not a waiver. You may not assign these terms without our consent.
